Physical Custody

Physical custody is when one parent provides most of the day-to-day care for a child.

Joint Physical Custody

Joint physical custody is when the child resides with both parents on a schedule.  For example, the child may reside with both parents for three days of the week while they alternate the remaining day.  Each parent is responsible for the child’s routine care on the day that the child lives with them.  However, joint physical custody does not mean that the parties share in the decision-making authority of the child unless ordered by the court.

Legal Custody

Legal custody is when one parent has the responsibility of making all of the major decision in a child’s life.  This can include things such as schooling, medical treatment, extracurricular activities, and religious upbringing.  However, legal custody is not dependent on who has physical custody of the child.

Joint Legal Custody

Joint Legal Custody is when both parents share in making major decisions in a child’s life.  This includes such things as schooling, medical treatment, extracurricular activities, and religious upbringing.  The parties must consult with each other on these matters.

MICHIGAN CHILD CUSTODY FACTORS

When the parties cannot agree on custody of a child, they may petition the court to make a ruling on the matter.  According to the Michigan Child Custody Act, there are several factors that must be considered in determining child custody and parenting time.

(a) The love, affection, and other emotional ties existing between the parties involved and the child.

(b) The capacity and disposition of the parties involved to give the child love, affection, and guidance.  Additionally, the continuation of the education and raising of the child in his or her religion or creed, if any.

(c) The capacity and disposition of the parties involved to provide the child with food, clothing, medical care, or other remedial care recognized and permitted under the laws of this state in place of medical care, and other material needs.

 (d) The length of time the child has lived in a stable, satisfactory environment, and the desirability of maintaining continuity.

 (e) The permanence, as a family unit, of the existing or proposed custodial home or homes.

(f) The moral fitness of the parties involved.

(g) The mental and physical health of the parties involved.

(h) The home, school, and community record of the child.

(i) The reasonable preference of the child, if the court considers the child to be of sufficient age to express preference.

(j) The willingness and ability of each of the parties to facilitate and encourage a close and continuing parent-child relationship between the child and the other parent or the child and the parents.

(k) Domestic violence, regardless of whether the violence was directed at or witnessed by the child.

(l) Any other factor considered by the court to be of relevance to a particular child custody dispute.

EVIDENCE NEEDED TO REQUEST A CHANGE OF CUSTODY

When an Order for Custody exists, a motion is be filed with the court asking the judge to modify the order.   The judge can only consider changing a custody order if there has been proper cause or a change in circumstances.  Therefore, it is the burden of the moving party to provide clear and concise information to support their request for a change of custody.
