PATERNITY
When a child is born of unmarried parents, it is typical that a paternity case is initiated to establish paternity. A paternity matter can be commenced by either the mother or the presumed father of the child.
A DNA test is ordered to confirm that the presumed father is the biological father of the child. An order for child custody, visitation, support, and healthcare can then be established. Historically, fathers who are not represented by a child custody and support attorney are awarded minimal visitation/custody while being ordered to pay the maximum calculated child support. CHILD SUPPORT REVIEW
In Michigan, either party can request a review for modification of child support every thirty-six (36) months or at such time as a party can prove that their financial situation has changed significantly. However, before a review can be conducted, the requesting party must file a motion with the court for approval.
When a review for modification occurs, both parties will be asked to submit some of the following information and documents:
- Recent paycheck stubs or proof of wages.
- Copies of federal and state income tax returns along with W-2s and 1099s.
- Copies of business tax returns if the party is self-employed.
- A Child Care Verification Form is they are asking for reimbursement of child-care expenses.
