SUMMONS AND COMPLAINT

Michigan is a no-fault divorce state.  In other words, the dissolution of a marriage does not require a showing of wrongdoing by either party

Pursuant to Michigan Law,  “(1) A complaint for divorce may be filed in the circuit court upon the allegation that there has been a breakdown of the marriage relationship to the extent that the objects of matrimony have been destroyed and there remains no reasonable likelihood that the marriage can be preserved. In the complaint the plaintiff shall make no other explanation of the grounds for divorce than by the use of the statutory language.”

After a Summons and Complaint is filed by the court, it is the responsibility of the filing party to serve the documents on the other party.  Depending on the method of service, the opposing party has 21 or 28 days to file an answer to the Complaint.

PENDENCY OF THE CASE

There are several aspects of a divorce that may need to be addressed during the pendency of a divorce case in court.  The most important issues to be resolved are the following:

  • Child custody
  • Child support and/or spousal support
  • Division of property
  • Division of assets
  • Responsibility of debt

LENGTH OF DIVORCE PROCESS

If the parties do not share minor children, there is a statutory 60-day waiting period. A judgment cannot be filed until 60 days after a Complaint has been filed.  However, it takes approximately four to six months for most cases.

If the parties share minor children, there is a statutory 6-month waiting period.  A judgment cannot be filed until 6 months after the filing of the Complaint.  However, it can take up to a year for a divorce when minor children are involved.

JUDGMENT OF DIVORCE

A Judgment of Divorce is a court order that states the terms of the divorce and dissolves the marriage.  A Judgment includes many important details.  It not only provides such things as the amount of child support and who is awarded property and assets, but includes the terms in which each party is to handle these matters.

POST-JUDGMENT MATTERS

If a party fails to follow the Judgment of Divorce or a party wishes to modify the Judgment of Divorce, it is necessary to file a motion with the court.  Macie Law handles post-judgment matters with the same care and attention as the divorce process.
