MICHIGAN PROBATE COURT ATTORNEY

There are many areas of law in which the probate court has jurisdiction over.  As a Michigan Probate Court Attorney, Macie Law handles the following matters:

  • Trust Proceedings
  • Matters related to the estate of a deceased person
  • Guardianships and Conservatorships

TRUST PROCEEDINGS

Typically trust proceedings forego probate court intervention.  However, there are a few exceptions where a Michigan Probate Court Attorney may be necessary in regards to a trust.

Some examples of exceptions that the probate court may become involved are:

  • An individual is left out of the trust who believes they should have been included;
  • There are disagreements or disputes with the trustee’s handling of trust assets;
  • There may be concerns that the trust grantor was manipulated or was in a compromised mental state when the trust was made and/or signed; or
  • There are suspicions that the original trust document was tampered with or that the signature(s) on the document are fraudulent.

If you are a trustee facing accusations of the validity of a trust or a beneficiary who may have concerns that fall within the exceptions, it is important that you contact a Michigan Probate Court Attorney to discuss your unique situation in detail.  At Macie Law, we offer free initial consultations.

DECEDENT’S ESTATE

When an individual passes away with a will (testate) or without a will (intestate), it may be required that an estate be opened and a personal representative be appointed.

The process of opening, administrating, and settling an estate can be complicated.  The probate courts are barred from giving legal advice.  Therefore, it is important that you contact an experienced Michigan Probate Court Attorney to be sure that the estate is handled correctly.  At Macie Law, we offer free initial consultations to discuss how we may help you.

GUARDIANSHIPS AND CONSERVATORSHIPS

A guardian is a person appointed by the probate court to make personal decisions for an individual who has been found to be incapacitated and unable to make these decisions on their own.  A conservator is a person appointed by the probate court to manage the financial affairs of an individual who has been found unable to manage their own affairs.

If you feel a family member should have a conservator or guardian appointed, it is important you contact a Michigan Probate Court Attorney to discuss your concerns in detail.   Macie Law offers free initial consultations.
